Spam Policy
At Rainycity, we have a zero tolerance spam policy. What this means, is one strike and you're out, and no refunds will be issued. You will be liable for all damages incurred by us or any of our customers and we will shut down your site.
You may wonder why we have such a harsh anti-spam policy. We take this stance since one spammer, can cause an entire string of IP addresses to be blacklisted by mail servers throughout the world. If this happens, innocent bystanders on our network are affected and their ability to send out legitimate email to their customers is hindered. Having said this, we do understand that sometimes spam is committed unintentionally by novice users. Unfortunately, this will still cause problems by us and everyone else on our network. We want our customers to be able to send legitimate email to their customers and not to be frustrated by blocked IP addresses that have been corrupted by previous spammers on our network.
If we determine the violation to be accidental, we will work with you to make a smooth transition to your new web host. We will also do our best to ensure a compromise between your continued business operations and our interests in maintaining a spam free network.

In a nutshell spam refers to unsolicited email OR email with false headers and misleading subject lines. Our servers are located in Washington State.
Examples of spam include:
Emails sent to recipients on a bulk email list obtained on a CD (i.e. 30 Million email users). Even if the vendor of this list claims the CD contains only "double opt in email addresses", common sense tells us this is not true. If you send email to users who did not give you explicit permission to do so, even if its not from our servers, this is considered spam and we will close your account with no refunds.
The use of the mail server for the transmission of unsolicited, commercial or non-commercial e-Mail is strictly forbidden. This includes but is not limited to, using any SMTP client designed for the purpose of sending mass e-Mail using addresses from a bulk list or database regardless of the content or intention of the outgoing e-Mail. Any usage, determined by RainyCity.net to be an abuse of this policy will result in immediate termination of the user's account without refund of payments due and collected, and the loss of all access to the services provided. If any detrimental action or injury is suffered by Rainycity.net, as a result of a user violating this policy, the user agrees to indemnify Rainycity.net from all damages resulting therein. This includes all damages, attorney fees, and other reasonable costs.
Once again, we will work with you in a smooth transition to your new webhost, and understand that you have a business to run. But, if you are considering spam as an email marketing tactic, we recommend you either consider a less taxing and obtrusive method of marketing, or consider another web host who allows spamming. Of course, if you do this, its very like you won't be able to email legitimate customers, because the web host will probably already be blacklisted by anti-spam databases.
